We reserve the right to update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the updated Terms.

2. Service Description

2.1 AI Face Swapping Service

AI Face Swap provides an artificial intelligence-powered service that allows users to swap faces in images and videos. Our Service includes:

  • Image Face Swapping: Replace faces in photos (~5 seconds processing)
  • Video Face Swapping: Replace faces in videos (~1 minute per 10 seconds of video)
  • Credit System: Pay-per-use model with credit packs and subscription plans
  • Account Management: Save history, manage credits, and access previous creations

2.2 Service Availability

While we strive to provide uninterrupted service, we do not guarantee that the Service will be available at all times. We may experience downtime for maintenance, updates, or unforeseen technical issues.

3. User Accounts

3.1 Registration Requirements

To use our Service, you must:

  • Be at least 13 years of age
  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Accept responsibility for all activities under your account

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials. You must notify us immediately of any unauthorized access or security breach. We are not liable for any loss or damage from your failure to protect your account information.

3.3 Account Termination

We reserve the right to suspend or terminate your account if you violate these Terms or engage in fraudulent, abusive, or illegal activities. You may also delete your account at any time through your account settings.

4. Credits and Payments

4.1 Credit System

Our Service operates on a credit-based system:

  • Image Face Swap: 1 credit per image
  • Video Face Swap: 10 credits per video (based on ~10 seconds)
  • Free Credits: New users receive 20 free credits upon registration

4.2 Purchasing Credits

You can purchase credits through:

  • Credit Packs: One-time purchases that never expire (1,000 / 4,000 / 10,000 credits)
  • Subscription Plans: Recurring credits with monthly, quarterly, or annual billing

4.3 Payment Processing

All payments are processed securely through Creem, our third-party payment processor. By making a purchase, you agree to Creem's terms and conditions. We do not store your credit card information.

4.4 Refund Policy

We offer a 7-day money-back guarantee on subscription plans. To request a refund, contact our support team at fwrd@qq.com. Credit pack purchases are generally non-refundable unless there is a technical issue preventing service delivery.

4.5 Subscription Cancellation

You may cancel your subscription at any time from your account settings. You will continue to have access to your subscription benefits until the end of your current billing period. Cancellation does not entitle you to a refund for the current billing period.

5. Acceptable Use Policy

5.1 Permitted Uses

You may use our Service for:

  • Personal entertainment and creative projects
  • Educational purposes and research
  • Commercial projects with proper consent and rights
  • Content creation with appropriate disclosures

5.2 Prohibited Uses

You may NOT use our Service for:

  • Non-Consensual Content: Creating content featuring individuals without their explicit consent
  • Deepfakes for Malicious Purposes: Creating misleading or deceptive content intended to harm, defame, or defraud
  • Sexual or Explicit Content: Creating pornographic or sexually explicit material
  • Minors: Creating any manipulated content featuring individuals under 18 years of age
  • Impersonation: Falsely representing yourself as another person for fraudulent purposes
  • Political Manipulation: Creating deceptive political content or election interference materials
  • Harassment or Abuse: Creating content to harass, bully, or abuse others
  • Intellectual Property Infringement: Using copyrighted material without permission

5.3 Content Monitoring

While we do not actively monitor all uploaded content, we reserve the right to review, remove, or refuse to process any content that violates these Terms. We may report illegal activities to law enforcement authorities.

5.4 Consequences of Violation

Violation of our Acceptable Use Policy may result in:

  • Immediate account suspension or termination
  • Forfeiture of all remaining credits without refund
  • Legal action if applicable
  • Reporting to law enforcement if criminal activity is suspected

6. Intellectual Property

6.1 Your Content

You retain all ownership rights to the images and videos you upload ("Your Content"). By uploading content to our Service, you grant us a limited, non-exclusive license to process, store, and display Your Content solely for the purpose of providing the Service to you.

6.2 Generated Content

You own the face-swapped images and videos generated by our Service ("Generated Content"), subject to the following conditions:

  • You had the legal right to use all source materials
  • You obtained necessary consents from individuals depicted
  • Your use of Generated Content complies with all applicable laws

6.3 Our Service

All intellectual property rights in the Service, including but not limited to software, algorithms, trademarks, and branding, are owned by AI Face Swap or our licensors. You may not copy, modify, reverse engineer, or create derivative works from our Service.

7. Disclaimer of Warranties

OUR SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Warranties of merchantability, fitness for a particular purpose, or non-infringement
  • Accuracy, reliability, or quality of results
  • Uninterrupted or error-free service
  • Security of data transmission or storage

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AI FACE SWAP SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, consequential, or punitive damages
  • Loss of profits, data, or goodwill
  • Service interruptions or data loss
  • Third-party content or actions

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

You agree to indemnify and hold harmless AI Face Swap, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Your Generated Content or distribution thereof

11. Governing Law and Disputes
